

Sorry its taken a while to reply, after reading your reply I went away and checked the County Court Buisness Centre Claim form and after challenging the claim within the 14 days my defence needs to be entered by Sunday the 18th November ( ISSUE DATE was 16th Oct 2018) and re wrote the defence taking your direction.Ĭould you or indeed anyone that may be able to help please look at the following and give your opinion. I am sure if you check your records for the time and date in question then there will have been a significant amount of tickets issued for this period due to the ticket machines not being in operation and I am certain that many appeals will have been lodged as a result.įor this reason I do not believe that the Penalty Charge Notice should have been issued in the first instance as at the time the driver was not able to purchase a ticket due to the machines being out of order.

When the driver returned to the vehicle just over an hour later they again checked the machines and they were still covered over and people were still unable to purchase a ticket. There were a number of other members of the public who were in the same predicament as the driver and they were also unable to make payment. The covers that were in place rendered the parking payment machines out of order and there were no alternative method of payment on offer at that time. The covers that were in place were official covers which covered the meters perfectly and not simply a plastic bag that had been placed over.

They immediately checked the other machine and found it to be in the same state. On entering the car park the driver parked up in a designated bay and approached 1 of the 2 parking meters that were in place to facilitate payment for a ticket.Īt that time the driver noticed that a cover was in place on the ticket machine making payment impossible.
